1. Acceptance of Terms

By accessing and using Lagoon's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services.

2. Description of Service

Lagoon provides a free, web-based platform for real-time audio and video communication, including virtual room creation, proximity-based audio, and collaborative features. This service is provided by UnderScape, an independent volunteer-based studio. The service is provided "as is" and may be modified, suspended, or discontinued at any time.

3. User Accounts

Account creation is optional. You can use Lagoon as a guest without registering. However, registered users benefit from persistent identity, saved preferences, and enhanced features.

If you choose to create an account, we collect:

• Username (display name)
• Email address
• Avatar (profile picture)
• TOTP code (generated server-side for passwordless authentication)

Passwordless Authentication: Lagoon uses a modern passwordless authentication system. Instead of passwords, we use TOTP (Time-based One-Time Passwords) generated by our servers, providing enhanced security without the hassle of remembering passwords.

You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your TOTP codes secure and not share them with anyone
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use at contact@under-scape.com

You can delete your account at any time through your account settings. Account deletion is permanent and will remove all your data from our servers.

4. User Conduct

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Transmit any viruses, malware, or malicious code
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Use automated systems to access the service without permission
• Collect or harvest any information about other users

5. Content and Data

Your Content

You retain ownership of any content you share through the service. However, by sharing content, you grant us a license to transmit that content to provide the service. Real-time audio, video, and messages are transmitted in real-time only and are never recorded or stored on our servers.

Account Data

For registered users, we store your username, email address, avatar, browser information, and TOTP authentication code. We do not store passwords as we use a passwordless authentication system. This data is stored indefinitely until you delete your account.

Guest users: If you use Lagoon without registering, we only process the minimum technical data necessary for the service to function during your session. We do not permanently store your IP address—it may only appear temporarily in server logs which are automatically cleared.

6. Intellectual Property

The service and its original content, features, and functionality are owned by Lagoon and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

7. Privacy

Your use of the service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

8. Third-Party Services

The service may contain links to third-party websites or services that are not owned or controlled by Lagoon. We assume no responsibility for the content, privacy policies, or practices of any third-party services.

9. Disclaimers and Limitations of Liability

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Lagoon shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

10. Indemnification

You agree to indemnify and hold harmless Lagoon and its affiliates from any claims, damages, losses, liabilities, and expenses arising out of your use of the service or violation of these terms.

11. Termination

We reserve the right to suspend or terminate your account and access to the service at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties, or for any other reason.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last Updated" date. Your continued use of the service after such changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with French law, without regard to conflict of law provisions.
